Applicant’s Request

The application for discharge review, received 020329, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The Applicant requested a documentary record discharge review. The Applicant listed the American Legion as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030107. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

1. (Equity Issue) This former member avers that he was innocent of the larceny charges filed against him and would have appealed his non-judicial punishment and administrative discharge board findings had it not been for the marital problems he was encountering at the time. On this basis, he petitions the Board for relief.

2. (Equity Issue) This former member further requests that the Board include provisions of SECNAVINST 5420.174C, enclosure (1), Chapter 9, as it pertains to post-service conduct, in assessing the merits of this application.

971029:  NJP for violation of UCMJ, Article 121 (2 specs): Larceny on 22Oct97.
         Award: Forfeiture of $268 per month for 7 days, reduction to EMFA. No indication of appeal in the record.

971029:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense as evidenced by your own sworn statement given to Naval Criminal Investigative Services on 22Oct97 and CO's NJP of 29Oct97 for violation of UCMJ Article 121 (two specifications of larceny).

971030:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

971121:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the Applicant had committed a serious offense, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

971222:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

980112:  Commander, Naval Special Warfare Command directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 980213 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The Applicant contends he was innocent of the larceny charges and he would have appealed the imposition of nonjudicial punishment and the findings of his administrative discharge board, but he was having marital problems at the time. The NDRB did not find any evidence that the Applicant's discharge was inequitable or improper. He was afforded an administrative discharge board. The Board found the Applicant committed misconduct and the appropriate characterization of service should be other than honorable. The NDRB agrees.

The Applicant contends he failed to appeal the imposition of nonjudicial punishment and the findings of his administrative discharge board because he was encountering marital difficulties. The NDRB recognizes that serving in the U.S. Navy is challenging. Our country is fortunate to have men and women willing to endure the hardships and sacrifices required in order to serve their country. The Applicant had every opportunity to appeal the imposition of nonjudicial punishment and the findings of his administrative board. The NDRB agrees that the Applicant's service was equitably characterized as being performed under other than honorable conditions.

The following is provided for the benefit of the Applicant. Normally, to permit relief, the discharge or characterization of the Applicant's service had to be improper or inequitable. There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Relief denied.

The Applicant is reminded that the period of eligibility for a personal appearance hearing is 15 years from the date of discharge. The application package must be submitted to the NDRB prior to the expiration of the 15 year period. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
