Applicant’s Request

The application for discharge review, received 020308, requested that the reason for the discharge be changed to Good of Navy. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 021115. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the narrative reason of the discharge shall not change. The discharge shall remain: HONORABLE/ PERSONALITY DISORDER, authority: NAVMILPERSMAN, Article 1910-122 (formerly 3620225).


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted

1. Block 28 on DD 214 reflects separation due to "Personality Disorder."
I believe the record on this block is in error & unjust for the following reasons: I was attending FTA School and I was falling behind. They sent me to a psychiatrist and I was discharged due to a "personality disorder". I believe that the navy treated me unjustly. The Navy decided to discharge me because of a personality disorder diagnosed by a psychiatrist that I had only had a 30-minute orientation with him. I was trying to stay in the navy to train in another specialty in a submarine, but the Navy decided on the psychiatrist opinion, which I feel is false. I don't or never have had a personality disorder. I have never been told I had a personality disorder prior to this. I graduated from Halls High, and was employed by the State of TN as a correctional officer - who has to pass a psychological test, and training. I worked as a dispatcher for the Town of Halls and a correctional officer for Lauderdale Co. I believe the Navy was wrong in their decision and request that reason for discharge, narrative reason for separation be changed on my DD214.

Chronological Listing of Significant Service Events :

991119:  Applicant diagnosed with a borderline personality disorder. The psychiatrist recommended separation based on a personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. Applicant was considered self-destructive and a continuing risk of harm to self or others.

991207:  Applicant notified of intended recommendation for discharge under honorable conditions (general) by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service.

991207:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

000121:  Commanding Officer, Naval Submarine School, Groton, CT directed an honorable discharge by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was honorably discharged on 991215 for convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Board does not consider the circumstances surrounding the Applicant’s stated condition and implied incorrect diagnosis to be of sufficient nature to warrant a change in the narrative reason for discharge. The Applicant was diagnosed with a borderline personality disorder by a competent medical authority on 991117. No other narrative reason more clearly describes the circumstances surrounding the Applicant’s processing for administrative separation. Relief denied.

The Applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
