Applicant’s Request

The application for discharge review, received 020214, requested that the characterization of service on the discharge be changed to honorable or under honorable conditions (general). The Applicant requested a personal appearance hearing before the Board in the Washington National Capital Region. The Applicant did not list any representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation by the Disabled American Veterans.

Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 021010. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the Applicant’s service. The Board’s vote was three to two that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct – Pattern of misconduct, authority: NAVMILPERSMAN, Article 3630600.

A personal appearance discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of Misconduct, authority: NAVMILPERSMAN, Article 3630600.

If appropriate add the following:

920827:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. Commanding Officer’s comments (verbatim): Since reporting on board DEFENDER MSSA (Applicant) has been a continuous administrative and disciplinary burden. Provided the opportunity to pursue his naval career in a highly positive environment in his chosen rating, he has adopted the attitude that Navy standards clash with his own and his plans for the future. Although his disciplinary infractions are generally minor in nature they are so repetitive that they are indicative of a conscious refusal to conform and his explanations place blame on every entity and circumstance but himself. His manipulative, dissenting attitude has had a negative impact in each workcenter that he has been assigned to and has caused serious problems throughout the crew. I most strongly recommend that he be separated from the naval service as expeditiously as possible.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 921002 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (C and D).

Issues 1 and 2. The Board found that the Applicant’s service to his country after his discharge sufficiently mitigated his pattern of misconduct while in the U.S. Navy to warrant an upgrade of his characterization of service to under honorable conditions (general). However, commanders and separation authorities are tasked to ensure that sailors receive no higher characterization than is due. While the Board found the Applicant’s post service conduct to be commendable, the Board determined that the Applicant’s record of service does not support an upgrade to Honorable.
