Applicant’s Request

The application for discharge review, received 020128, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020829. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL UNDER HONORABLE CONDITIONS/PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 3630600.

Issues, as submitted

1. Was discharged from the Navy due to receiving a DUI and driving on a suspended license.

2. I feel other than the two above incidents I was a good service member, as my military records would show.

3. I feel I made two very bad decisions, and I will live with what ever review this board makes with my lack of evidence.

4. Received a good conduct medal for period ending 96 Jan 01.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 970603 with a discharge characterization of general (under honorable conditions) for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issues 1-4. The Board disagrees with the Applicant
s assertion that his overall service record warrants an honorable discharge. Upon review of the official record, the Board discerned the characterization of service, as well as the narrative reason for separation, accurately reflects the Applicant s service to his country. When a Sailor s service has been honest and faithful, it is appropriate to characterize that service as honorable. A characterization of general (under honorable conditions) is warranted when significant negative aspects of a member s conduct or performance of duty outweigh the positive aspects of the member s military record. Although the Applicant was awarded a good conduct medal for the period ending January 1, 1996, his performance evaluation for the reporting period September 9, 1995-June 15, 1996 states Petty Officer (Applicant) consistently shows contempt for authority and displays a lack of respect for all appointed over him. In addition, the Applicant s service was marred by award of non-judicial punishment (NJP) on two occasions and a subsequent period of unauthorized absence, which resulted in his discharge. The Applicant s conduct, which forms the basis for determining the character of his service, reflects his willful disobedience of the orders and directives that regulate good order and discipline in the naval service, and falls short of that required for an honorable characterization of service. Relief denied.

The Applicant’s discharge was proper and equitable.
Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
