Applicant’s Request

The application for discharge review, received 020123, requested that the characterization of service on the discharge be changed to general/under honorable conditions and the reason for the discharge be changed to RE-3 or RE-2. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 021121. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

The situation was I was married and in love to the fullest extent my wife told me that sh was leaving I was very confused and depressed at the time now Im on track with my life she has used me to get her license to become a beautician she come pleated the cores and then she decided that she didn't need me anymore and threatened me that she would take everything I owned so she left one night I tried to go to sleep and couldn’t sleep I drank six beers and couldn’t sleep still I went to go get more beer drank four and still couldn’t sleep I called shipmates and no answer walked down the street to see if the neighbors were home they warrant on my way back home another one of our neighbors was outside with his dog I didn’t really know him I just needed someone to talk to and we talked outside for about five minutes he invited me inside I went we talked for about thirty minutes of so then he went upstairs and came down with some lit marijuana and was talking then I made the biggest mistake in my life I took two pulls the next day I had a urinalysis all hands I had been drug free for eight years before that and I am drug free now it was just me being in the wrong place at the wrong time its all my fault I should have know better I know but under the influence people do some things that can influence there lives I also quit drinking because of that I just hope I can please have my RE Code changed I know I made a mistake and Im sorry I’ve apologized to my command also for letting them down

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 001214 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the naval service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter. Relief is therefore denied.

Issue 2: The Applicant used illegal drugs. Drug abuse warranted processing for separation, normally under other than honorable conditions. The Applicant’s own misconduct caused him to be administratively processed for separation. The record is devoid of evidence that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions.
The Applicant’s conduct, which forms the primary basis for determining the character of is service, reflects his disobedience of the orders and directives that regulate good order and discipline in the naval service, and falls short of that required for an honorable characterization of service. An upgrade to general under honorable conditions would be inappropriate. Relief denied.

Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
