Applicant’s Request

The application for discharge review, received 020821, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. Upon accepting the application, the Naval Discharge Review Board advised the Applicant that he was approaching the fifteen year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, D.C. area. Applicant did not respond.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030522. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER CONDITIONS OTHER THAN HONORABLE/Separation in lieu of trial by court-martial, authority: MARCORSEPMAN Par. 6419.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. At the time of my agreement to receive a OTH Discharge in lieu of trial by courts martial. I was an emotional wreck, the loss of my father and a messy divorce, I feel I was guided in this direction by the folks in admin. Had I known that this was going to leave a big hole in my life I would have taken the punishment of jail, loss of pay & rank or what ever the court decided. This was along time ago. I am asking (requesting) an upgrade in discharge and removal of the RE-4B Code so that I may re-enter into the Navy Reserves as a medical officer, I currently am certified in the State of Colorado as well as nationally registered as an emergency medical technician. Please allow me to regain my self respect and fulfill my commitment to my country.

880531:  NAVDRUGLAB, San Diego, CA, reported Applicant’s urine sample, received 880520, tested positive for amphetamine/methamphetamine.

880811:  Charges preferred to special court-martial for violation of the Uniform Code of Military Justice (UCMJ) Article 86: Unauthorized absence from 0900, 880613 until 1525, 880729 (46 days/apprehended) and Article 112a: Wrongful use of methamphetamine.

880812:  Applicant, having consulted with counsel certified under UCMJ Art 27b, requested discharge for the good of the service to escape trial by court- martial. In the request the Applicant noted that his counsel had fully explained the elements of the offenses for which he was charged and that he understood the elements of the offenses. He further certified a complete understanding of the negative consequences of his actions and that characterization of service would be under other than honorable conditions. The Applicant admitted guilt to the following violations of the UCMJ, Article 86: Unauthorized absence from 0900, 880613 until 1525, 880729 (46 days/apprehended) and Article 112A: Wrongful use of methamphetamine.

880829:  SJA review determined the case sufficient in law and fact.

880830:  GCMCA [Commanding General, 1
st Marine Division (Rein), FMF, Camp Pendleton, CA] determined that Applicant had no potential for further service, that separation in lieu of trial by court-martial was in the best interest of the service, and directed discharge under conditions other than honorable by reason of conduct triable by courts-martial.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 880927 under conditions other than honorable in lieu of trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. On 880812, the Applicant requested separation under conditions other than honorable in lieu of trial by court-martial. In his request, he certified that he had a complete understanding of the negative consequences of his actions and that characterization of service would be under other than honorable conditions. Even if the Applicant had accepted the special court-martial, the Board found no reason to believe that his discharge would have been anything except under conditions other than honorable. While he may feel that his emotional state at the time was a factor that contributed to his actions, the record clearly reflects his disregard for the requirements of military discipline and demonstrated that he was unfit for further service. The record is devoid of evidence that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter. Relief is therefore denied.

The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

A. Paragraph 6419, SEPARATION IN LIEU OF TRIAL BY COURT-MARTIAL, of the Marine Corps Separation and Retirement Manual, (MCO P1900.16C), Change 2, effective 15 May 84 until 26 Jun 89.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 86, unauthorized absence for more than 30 days; Article 112a, wrongful use of a controlled substance.
