Applicant’s Request

The application for discharge review, received 020422, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation by the Veterans of Foreign Wars.

Decision

A documentary discharge review was conducted in Washington, D.C. on 030124. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/IN LIEU OF TRIAL BY COURT-MARTIAL, authority: MARCORSEPMAN Par. 6419.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. My discharge should be changed to honorable because it was based on one isolated incident in 3 1/2 years of faithful, dedicated, and honorable service with no adverse actions.
I loved the Marine Corps and would've made it a career. Now I'm trying to become a Texas State Trooper. I need this upgraded in order to become a trooper.
I was the Marine of the Quarter board, I was on the color guard for 1 1/2 yrs and I was the color sergeant.

2. Applicant indicated above requested that Veterans of Foreign Wars act as counsel concerning his application. His records were reviewed on 11/12/02 and the following comments are hereby submitted.

Based on the records we reviewed, it is obvious that a question of inequity and propriety issue exist. Awardement of a UOTH discharged for a DWI offense does not make any sense. We fully concur with his contention that his discharge be upgraded to Honorable. This was an outstanding marine.

We refer this case to the Board for the careful and compassionate consideration and request the Applicant's discharge be reviewed for upgrade to honorable.

980331:  Applicant informed eligible but not recommended for promotion to Cpl due to a pending DWI IAW MCO P1400.32B, par 1204.3k for a period of 1 month, if applicable, unless waived by my Commanding Officer.

981119:  GCMCA [Commanding General, 1 st Marine Aircraft Wing] directed discharge under other than honorable conditions by reason of conduct triable by courts-martial. Enclosure (3) materially supports the basis for separation. However, it has been removed per paragraph 6419 of reference (a).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 981222 under other than honorable conditions in lieu of trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issues 1 and 2. The Board has no authority to upgrade a discharge for the sole purpose of enhancing employment opportunities as requested in the issue. The Applicant did not submit sufficient documentation to overturn the presumption that his request for separation in lieu of trial by court-martial and admission of guilt to the offenses charged against him was proper and equitable. Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 6419, SEPARATION IN LIEU OF TRIAL BY COURT-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective
18 Aug 95 until present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ.
