Applicant’s Request

The application for discharge review, received 020226, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a personal appearance hearing before the traveling board. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the Applicant, he was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington, D.C. area. The NDRB also advised that the board first conducts a documentary review prior to any personal appearance hearing.

Decision

A documentary discharge review was conducted in Washington, D.C. on 021105. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.6.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. During my time in the United States Marine Corps I always respected all laws set forth by the UCMJ. Unfortunately in August of 1996 I made a decision that was not only unwise but the most horrible decision in my life. I not only put my life in danger but the life of a fellow Marine and innocent civilians. Since that night my life has completely changed. The time that I spent in the Marines was the best experience I have had. My service record book documents that I never was in any trouble until the night of August 15, 1996. I was always promoted on time as well of having above average physical fitness test scores. Also, my pro and con marks were well above average which left me up for promotion again until I was involved in my accident. In short my time spent in the Marine Corps was an experience that changed my life and also was spent honorable until a bad decision cost me every thing. Please take this application into consideration for upgrading my discharge to honorable. Hopefully, after reading this my discharge will reflect the time I spent serving my country honorably and not a bad decision that I made.

Chronological Listing of Significant Service Events :

961204:  Civil Conviction: Superior Court of California, County of San Diego for violation of driving under influence of alcohol or drugs causing injury and driving with a measurable blood alcohol level on 18 Aug 96.
Sentence: Fine $1100, restitution $200, formal probation for 5 years, volunteer at a non-profit organization, work for 400 hours, complete the MADD victim impact program and the first conviction program.

961220:  Counseled for deficiencies in performance and conduct. [Alcohol related incident. Specifically, being convicted of (2) felony charges; felony DUI and serious bodily injury with a motor vehicle.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

961230:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

961230:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

970107:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense. The factual basis for this recommendation was the police report evidencing the conviction for driving under the influence of alcohol or drugs causing injury.

970127:  SJA review determined the case sufficient in law and fact.

970127:  GCMCA [Commanding General, 1 st Marine Division (Rein)] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 970207 under other than honorable conditions for misconduct due to the commission of a serious offense (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. A characterization of service of under other than honorable conditions is warranted when the member's conduct constitutes a significant departure from that expected of a Marine. T he Applicant’s service was marred by a civil conviction for driving under the combined influence of alcohol and a drug, and inflicting bodily injury on another person. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful disobedience of the orders and directives which regulate good order and discipline in the naval service, and falls short of that required for an honorable characterization of service. The positive aspects of the Applicant’s record do not mitigate his misconduct. An upgrade would be inappropriate. It must be noted that most Marines serve honorably and well and therefore earn honorable discharges. In fairness to those Marines, commanders and separation authorities are tasked to ensure that undeserving Marines receive no higher characterization than is due. Relief denied.

The Applicant’s discharge characterization accurately reflects his service to his country. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.

A. Paragraph 6210, MISCONDUCT of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 31 January 1997 until present).

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 111, drunken driving resulting in personal injury.
