Applicant’s Request

The application for discharge review, received 020226, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 021105. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: BAD CONDUCT DISCHARGE/COURT-MARTIAL, authority: MARCORSEPMAN Par. 1105.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. I went UA in March of 97. (which I admit was a very bad mistake, for which I paid dearly in lost pay and harassment. I had problems with my numerous commands after that. I would get page 11's for being overweight so I couldn't get promoted or my good conduct medal. My 1 st Sgt at the time (1 st Sgt T_, C_) said he would promoted me back to LCpl on Sept 1, 1997 (He also told my mother who was visiting me) it did not happen. 1 ST T_ said I was 2 LBS overweight. I tried very hard to do what the command wanted- I was never able to do this even tho I excelled in my assignments. I know nothing of the time lost on 19980519-19980524. From 19900106 -19900110 I was stuck in West Virginia from the snow because my ride (who had a 4x4) left me. Both my mother & I called the company and I was told to get back as soon as I could do so safely. See my mother’s statement. From Mar 27, 2001 to May 23, 2001 I was in the brig. I respectfully request that my discharge be changed to honorable so that I can get on with my life. I can only say that I'm sorry for any inconvenience I caused but I do not think I should be punished for the rest of my life. If the review board rules in my favor I will spent my time proving that I am worthy of this. Thank you for your consideration, more to follow.

980414:  NJP for violation of UCMJ, Article 121: On or about 0900, 980331, did steal (3) packs of cigarettes, the property of LCpl C. M. E_.
         Award: Forfeiture of $463.00 pay per month for 2 months (suspended for 6 months), restriction and extra duty for 45 days, reduction to E-1. Not appealed.

980416:  Counseled for deficiencies in performance and conduct. [Pattern of misconduct, specifically continuous violation of the UCMJ.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

990120:  NJP for violation of UCMJ, Article 86: Did on or about 0700, 990106, without authority, absent himself from his appointed place of duty to wit: A Company, 1
st Battalion, 1 st Marines, 2d Marine Division, and did remain so absent until 2200, 990111.
         Award: Forfeiture of $479.00 pay per month for 2 months, restriction and extra duty for 45 days. No indication of appeal in the record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 010723 with a bad conduct discharge which was the sentence adjudged by a properly constituted special court-martial that was determined to be legal and proper, affirmed in the legal chain of review and executed (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. With respect to a discharge adjudged by a court-martial case, the action of the NDRB is restricted to upgrades based on clemency (C, Part IV). The Applicant’s case was considered under the pertinent standards of equity to determine if any factors in this particular case merited clemency. The NDRB found the Applicant’s service record devoid of any mitigating or extenuating factors sufficient to offset the seriousness of the offenses for which the discharge was awarded. Relief denied.

The Applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURT-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 950818 until present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 86, unauthorized absence; Article 121, larceny; Article 123, forgery.
