Applicant’s Request
The application for discharge review, received 010830, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 020328. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED (Entry Level Separation) but the reason, authority and separation code for discharge will be administratively corrected to: CONDITION, NOT A DISABILITY, authority: NAVMILPERSMAN, Article 1910-120 (formerly 3620200).

 1. I feel my discharge status should be changed so I may reenter the U.S. Navy. The issues that forced me out are now passed and I feel it is my duty to reenlist for my prior contract.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990712 with an uncharacterized (entry level separation) for convenience of the government due to a physical or mental condition, not a disability. (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1 states that the applicant requested his discharge be changed so he may re-enter military service. He states that the issues that forced him out are now passed, and it is his duty to reenlist. The Board found no impropriety or inequity in the discharge. The applicant served 19 days on active duty. An Entry Level Separation (Uncharacterized) is the only discharge he is qualified to receive. Additionally, the Board will not change a discharge to allow an applicant to re-enter military service or gain employment. The applicant should consult his local recruiter to explore enlistment opportunities. Relief is denied.
