Applicant’s Request

The application for discharge review, received 010823, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant listed American Legion as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020328. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: BAD CONDUCT/Convicted by special court martial, authority: NAVMILPERSMAN, Article 3640420.

811022:  NJP for violation of UCMJ, Article 128: Assault on 810801.
         Award: Forfeiture of $250.00 per month for 1 month (suspended for 6 months), restriction and extra duty for 45 days. No indication of appeal in the record.

         CA 851112: The sentence is approved and excepting the bad conduct discharge will be duly executed. However, the unserved portion of confinement at hard labor is suspended for 6 months.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 870702 with bad conduct due to convicted by special court martial (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1 states: “(Equity Issue) Pursuant to 10 USC 874 (b) (UCMJ, Article 74) and in accordance with SECNAVINST 5420.174C, enclosure (1), paragraph 2.24 and 9.3, this former member requests the Board's clemency relief with upgrade of his characterization of service to under honorable conditions on the basis of his post-service conduct.” The applicant's case was considered under the pertinent standards of equity to determine if any factors in this particular case merited clemency. The NDRB is authorized to consider outstanding post-service factors in its consideration of circumstances that warrant clemency. The Board determined the seriousness of the applicant’s misconduct while serving in the military significantly outweighs his post-service accomplishments. The applicant’s employment, although it is honorable to serve as a firefighter, is not enough to overcome his egregious behavior while enlisted in the Navy. The Board determined the relief based on this issue is denied. The applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Legal representation at a personal appearance hearing is highly recommended but not required. Relief based on clemency is not warranted.
