Applicant’s Request

The application for discharge review, received 010705, requested that the reason for the discharge be changed. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020130. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the NDRB discerned no impropriety or inequity in the discharge. The Board’s vote was unanimous that the reason for discharge shall not change. The discharge shall remain: HONORABLE/ PERSONALITY DISORDER, authority: NAVMILPERSMAN, Article 3620225.

951016:  Commenced 36 months of active duty under the Airman Apprenticeship Training Program.

970718:  Mental Health Unit, Branch Medical Clinic, NAS North Island, San Diego, CA: Based on clinical interview, pt's self report & behavioral observation and psychological testing results the following diagnoses and recommendation:
Diagnoses: AXIS I - Adjustment Disorder with Depressed and Anxious Mood; AXIS II - Personality Disorder NOS with Avoidance & Compulsive Personality Features; AXIS III - As per medical records.
Recommendation: Pt is not mentally ill but manifests a longstanding disorder of character & behavior which renders her incapable of serving adequately in the USN. Although not currently suicidal or homicidal, she is judged to represent a continuing danger to self/others if retained in the USN. Consequently, she is strongly recommend for an Expeditious Administration Separations. Pt and command have been advised of the recommendation. Pt may return for counseling.

970804:  Applicant notified of intended recommendation for discharge with the least favorable characterization of service as General (under honorable conditions) by reason of convenience of the government on the basis of a diagnosed personality disorder as evidenced by Psychological Evaluation from LT S. J. S_, MSC, USNR, Staff Psychologist, Mental Health Unit, Branch Medical Clinic, Naval Air Station, North Island.

970804:  Applicant advised of her rights and elected to waive all rights.

970804:  CO, Sea Control Squadron 41, San Diego, CA advised BUPERS that applicant recommended for discharge with an by reason of convenience of the government on the basis of a personality disorder as evidenced by Psychological Evaluation from LT S. J. S_, MSC, USNR, Staff Psychologist, Mental Health Unit, Branch Medical Clinic, Naval Air Station, North Island.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970812 with an honorable for convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the applicant incapable of serving adequately in the naval service. (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant requested the reason for discharge be changed and stated: “I think #28 of DD 214 was not fare to my character, I would like to see that comment change. Thank you for your cooperation in this matter.” The NDRB carefully reviewed the applicant’s service record and found the reason for discharge was based on a properly diagnosed personality disorder. The Board found no impropriety or inequity in the discharge. To change the reason would be inappropriate. Relief is not warranted.
