Applicant’s Request

The application for discharge review, received 010626, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020110. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).




PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. In a contract I received at MEPS (Gunter AFB, Montgomery AL). It stated that I was to receive an A School of either information’s Technician or Sonar Technician school after a period of 18 months in a non-designated rate (Deck dept.) aboard my first command - The USS Kearsarge. After only a few months aboard my ship, I was informed by my chain of command that because of poor work evolutions, that I would not be eligible for my schooling. To say the least, I was disappointed and rather than appeal through my C.O. I irresponsibly went UA several times, which I now regret. As a young man with no college education and no means of which to pay for a 4 year degree. It makes higher and/or better job opportunities difficult for a man of limited education. I am not making any excuses for myself. I know what I did was wrong but now I respectfully request that my discharge be changed to honorable and my reentry code be upgraded or at least the latter. So that I may be able to rejoin the service. I ask this not for myself but for my wife and soon-to-be daughter. They deserve better than what I can offer them here in the "civilian world". If it seems that I am using my family as a vice, I apologize for it was not my intention. I only want what is best interest. Attached is a copy of discharge paper from the Navy to help clear things up. Any help you may give will be greatly appreciated.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 001109 general (under honorable conditions) for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter. Relief is therefore denied.

The applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful disobedience of the orders and directives which regulate good order and discipline in the naval service, and falls short of that required for an honorable characterization of service. The applicant, after consulting with legal counsel, waived his right to contest the characterization of service at an administrative hearing while being processed for discharge in 2000. Under Honorable Conditions (General) most clearly describes the applicant’s characterization of service. An upgrade to honorable would be inappropriate. Relief denied.

Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. He is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Legal representation at a personal appearance hearing is highly recommended but not required. Relief denied.
