Applicant’s Request

The application for discharge review, received 010417, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a personal appearance hearing discharge review before the Board in the Washington National Capital Region. The applicant listed American Legion as the representative on the DD Form 293.


Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 020415. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/ Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.
A documentary discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 890919 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (C and D).

Issue 1. The Board found that the applicant’s age, education level, and test scores qualified her for enlistment. While she may feel that her diagnosed personality disorder was a factor that contributed to her actions, the record clearly reflects her willful disregard for the requirements of military discipline and demonstrated that she was unfit for further service. The record is devoid of evidence that the applicant was not responsible for her conduct or that she should not be held accountable for her actions. Involuntary separation for misconduct takes precedence over discharge for medical reasons. Relief denied.

Issue 2. The applicant states that her post-service conduct has been sufficiently creditable to warrant an upgrade to her discharge characterization. The Board determined that although the applicant’s discharge was determined to be proper and equitable at the time of discharge the applicant’s post-service accomplishments demonstrate that she is a person of good character and conduct and deserving of partial relief. The Board determined the discharge shall change to under Honorable conditions (General).
