Applicant’s Request

The application for discharge review, received 010329, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010928. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

Issues

1. I do not think that my discharge was inequitable or improper. I am requesting an upgrade to hopefully reinstate my VA benefits, primarily the GI Bill which I contributed the full $12,000 required during my first full year of enlistment.
I would like to attend college and further my education, and the help of the G.I. Bill would be greatly appreciated, ie my discharge cannot be upgraded and VA benefits cannot be reinstated, I'm curious of what becomes of the $12,000 contributed my first year of enlistment.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980724 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue states: “I do no think that my discharge was inequitable or improper. I am requesting an upgrade to hopefully reinstate my VA benefits, primarily the GI Bill which I contributed the full $12,000 required during my first full year of enlistment.” The Board conducted a documentary review of the discharge and found no impropriety or inequity. The Board will not change a discharge to enable an applicant to secure VA benefits. The applicant should consult with the VA to determine his benefit eligibility as well as procedures governing unused contributions forfeited by less than honorable discharges. Relief is not warranted.

The NDRB is authorized to consider post-service factors in the re characterization of a discharge. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant failed to provide documentary evidence to demonstrate his sobriety, positive community service, employment history, and clean police record. Relief is not warranted.

The applicant is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is recommended .
