Applicant’s Request

The application for discharge review, received 010302, requested that the characterization of service on the discharge be changed to Honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010817. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).










PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I believe my discharge was improper because of the length of time I served in the Armed Forces, and because of the position I held there. Although I was not a qualified naval aircrewman or a qualified in-flight technician, I did acquire over 1175 flight hours in about 20 months, and was ready for my check-ride when I lost my top-secret clearance. In addition, I earned a 3-year good conduct medal while I served as well as numerous outstanding PRT awards. I was dedicated and seriously motivated while I was enlisted in the Navy, and would like to continue my aeronautical motivation by continuing with a college degree. An honorable discharge would allow me to further this education.

My discharge was based upon one incident, which I have regretted ever since that moment, and my accomplishments while I served did not have a bearing on that type of discharge decision. I have wanted to join the naval reserve as well after my discharge, and a general discharge does not permit that. I love my country and would like to continue to serve in any way I can.

I hope you pay close attention to my service record and my accomplishments while I served and can upgrade my discharge to an honorable one. Thank you for your time and consideration.

000313:  Applicant notified of intended recommendation for discharge under Other Than Honorable conditions by reason of misconduct due to the Commission of a serious offense and homosexual conduct.

000313:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ, Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

000313:  Commanding officer recommended discharge under Other Than Honorable conditions by reason of misconduct due to the Commission of a serious offense and homosexual conduct. Commanding officer’s comments (verbatim): ATAN (applicant) was caught shoplifting at the Main Exchange on or about 9 December 1999. He was subsequently awarded punishment at Captains' Mast for this offense. On or about 18 January 2000 he presented a declaration to the command that he is a homosexual. I recommend that ATAN (applicant) be processed for discharge and his service be characterized as Other Than Honorable due to commission of a serious offense.

000327:  CNMPC directed the applicant's discharge General (under Honorable conditions) by reason of misconduct due to the Commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 000410 General (under Honorable conditions) for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The applicant states his discharge was improper because of the length of time he served and because of the position he held there. The applicant was discharged for Commission of a serious offense. He was on unauthorized absence, was guilty of larceny and made a voluntary statement that he was bisexual. The discharge process was proper and equitable, therefore relief is denied.

Issue 2. The applicant states his discharge was based on one incident. The applicants discharge was based on violation of UCMJ, Article 121 and his voluntary statement that he was bisexual. The discharge process was proper and equitable. Relief denied.

The following is provided for the benefit of the applicant. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Evidence of continuing educational pursuits, an employment record, documentation of community service, certification of non-involvement with civil authorities and proof of his not using drugs, are examples of verifiable documents that should have been provided to receive consideration for clemency, based on post-service conduct. The applicant did not provide any of these documents. He is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Legal representation at a personal appearance hearing is highly recommended but not required.
