Applicant’s Request

The application for discharge review, received 001218, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010629. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I need this weight off my shoulders so I can move on with my life. I have been drug free for about five months now. Yes, I continued to use drugs for about a month after I was discharged, that's how long it took me realize what I have lost. When I joined the navy, I wanted to make a career out of it. I was the top pre calculus student at oak ridge high school for 1998. I looked at the nuke program and I saw endless possibilities. I lost sight of my goals. I started to go to Florida and meet the wrong people. I started doing ecstacy. I thought I could beat the system. For a while I wondered why it happened to me why did I throw away my dreams. Then I realized that I was taking everything for granted. I didn't realize how lucky I was to be where I was at. Why I lost it. I am grateful that I was caught because I was scared of where I was headed, just too afraid to do anything about it. Since my discharge I feel as if I have made a decent recovery. I have worked temp jobs up until the last few weeks until walmart gave me a break, I want to try and get into school this semester, but I can't afford it, I am getting all of my debts resolved. The only thing I can't get through is my discharge. I feel I have a lot to offer society, but I don't feel like I can do it without an honorable discharge because anything I do will not matter as long as I have an other than honorable discharge in my past. So I appreciate your time and consideration.

Award: Oral Reprimand, forfeiture of $585.00 per month for 2 months, restriction and extra duty for 00 days, reduction to E-3. No indication of appeal in the record.

000121:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

000121:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

000124:  CAAC indicates result of the intake assessment were that the patient does not meet DSM-IV criteria for drug abuse. No diagnostic impression found.

000127:  Commanding Officer, Naval Nuclear Power Training Unit recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

000210:  Commander, Navy Region Southwest authorized the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 000313 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue describes the circumstances surrounding his discharge and that he has been drug free for “about five months.” The Board found it commendable that the applicant has been drug free for five months, but does not find that a long enough time to demonstrate sobriety and warrant relief. The applicant should document his sobriety through regular drug testing for a period greater than five years. Relief is not warranted.

The NDRB is authorized to consider post-service factors in the re characterization of a discharge. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant failed to provide documentary evidence to demonstrate his sobriety, positive community service, employment history, and clean police record. Relief is not warranted.

The applicant is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is hearing is recommended.
