Applicant’s Request

The application for discharge review, received 010803, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020215. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/UNSAT PARTICIPATION IN READY RESERVE, authority: MARCORSEPMAN 6213.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My name is S_ B_ (Applicant); I was a member of the United States Marine Reserve in Alcoa, Tennessee. I joined the Marine Reserves in May of 1993 after completing High School. After completing basic training and MOS training, I met an influential young woman, whom I later married. During this time she did not understand the obligation that I needed to fulfill and in turn persuaded me to do other things other than my tour of duties. I regret that this has occurred and as much as I would like, a man cannot remove elements of the past, only learn form the experiences. At this time I would like to approach you with the intent to improve my life by upgrading my discharge status from Administrative other than Honorable Discharge to that of Honorable Discharge. Since my discharge from the United States Marine Reserve, I have been divorced and remarried to a wonderful woman and have accepted many responsibilities at work and in the community. I have worked many hours as a reserve sheriff's deputy with the J_ County Sheriff's Department and currently work as a special deputy of the K_ County Sheriff's department at St. Mary's Health System. My status in the community is well respected, that I have worked hard to achieve. Your consideration for what I am asking is appreciated. Chronological Listing of Significant Service Events :

930326:  Enlistment contract into the USMCR documents acknowledgement of the requirement to participate in 48 scheduled drills and not less than 14 days of annual training per year for 6 years upon completion of initial active duty training.

930921:  Commenced Initial Active Duty for Training (IADT).

940528:  Released IADT, having served 8 months, 8 days of active duty; received characterization of service as "honorable".

951007:  Counseled for deficiencies in performance and conduct [failure to obey a lawful order and lackadaisical attitude towards order given]. Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

960723:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

960723:  Applicant made following statement: "I S_ D_ (Applicant) have no desire to be in the USMCR do to back problems. I feel if I returned to the unit I will be treated different from the other members and by the other members of the unit."

970520:  Commanding officer recommended discharge under other than honorable conditions by reason of unsatisfactory participation in the Ready Reserve. The factual basis for this recommendation was member's demonstration of no desire to fulfill his obligation to the Marine Corps and his unwillingness to conform to regulations provided under the UCMJ.

970806:  SJA review determined the case sufficient in law and fact.

970806:  GCMCA [Commander, MFR, New Orleans] directed the applicant's discharge under conditions other than honorable by reason of unsatisfactory participation in the Ready Reserve.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970819 under other than honorable conditions for misconduct due to unsatisfactory participation in the Ready Reserve (A, B, and C). The Board presumed regularity in the conduct of governmental affairs (D). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (E and F).

Issue 1. The record is devoid of evidence that the applicant was not responsible for his conduct or that he should not be held accountable for his actions. The applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable.
Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Evidence of continuing educational pursuits, an employment record, documentation of community service, certification of non-involvement with civil authorities and proof of his not using drugs, are examples of verifiable documents that should have been provided to receive consideration for relief, based on post-service conduct. The applicant did not provide sufficient documentation to warrant an upgrade to his discharge. He is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Legal representation at a personal appearance hearing is highly recommended but not required. Relief denied.
