Applicant’s Request

The application for discharge review, received 000626, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance hearing discharge review before a traveling panel closest to PHOENIX, AZ. The applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the applicant, he was informed that the Naval Discharge Review Board (NDRB) did not travel and all personal appearance hearings are held in the Washington National Capital Region. The Naval Discharge Review Board (NDRB) also advised that the board first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010125. After a thorough review of the records, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: ENTRY LEVEL SEPARATION (UNCHARACTERIZED)/Other physical/mental conditions - personality disorder, authority: NAVMILPERSMAN, Article 3620200.

1. In 1991 I received an entry level separation (uncharacterized) but given a re-enlistment code of 4. I was recently informed that I had little chance of re-enlistment with a RE-4. I am requesting this hearing for a chance that I may re-enlist. I feel now that I have matured and that I have as much to offer the Navy as the Navy has to offer me. I truly regret my past mistakes and hope to make them right.

911122:  Psychiatric Evaluation: Applicant diagnosed with Personality Disorder, Narcissistic, Immature Features. The
psychiatrist recommended applicant be expeditiously administratively separated based on a long standing disorder of character and behavior which as of such severity as to render the applicant incapable of serving adequately in the naval service. He will not benefit from treatment. Although currently considered a low risk fo self/other harm, he is deemed a continuing risk to self or others if retained in the military.

911129:  Applicant notified of intended recommendation for discharge by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the applicant incapable of serving adequately in the naval service as evidenced by psychiatric evaluation dated 911122.

911129:  Commanding officer recommended discharge by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the applicant incapable of serving adequately in the naval service.

911212:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.


PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 911230 entry level separation (uncharacterized)on the basis of a diagnosed personality disorder of such severity as to render the applicant incapable of serving adequately in the naval service. (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In response to the applicant’s issue, the Board determined that no other discharge characterization or reason for discharge is more fitting than the one received by the applicant. The applicant had less than six months of active duty and had received a psychiatric evaluation that determined that the applicant had a personality disorder. The Board finds no reason to change the applicant’s discharge and will not grant relief concerning this issue.
