Applicant’s Request
The application for discharge review, received 000622, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 010125. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED (ENTRY LEVEL SEPARATION)/ERRONEOUS ENTRY (OTHER), authority: NAVMILPERSMAN, Article 1910-130 (formerly Article 3620280).

1. I request a change in Character of Service and Narrative Reason for Separation. I received a waiver when I enlisted in the Navy. They were made aware of my history as far as my right ankle being broken when I was 12 and the waiver was granted. Please obtain a copy of my 201 file which should contain a copy of the waiver I signed. I wish to reenlist in the Navy and cannot until the RE Code s changed. I have no problems with my ankle now. I run on a regular basis and work out on a daily basis and have had no problems with my ankle since my release from service. Your favorable response will be appreciated.

970812:  Report of Medical Examination upon entry: Applicant disclosed pre-existing medical conditions [fractured right ankle].
980126:  Medical evaluation indicate patient breaking his right ankle at age of 12, patient states having surgery to repair it, patient also states being told he had arthritis in it, now patient feels constant pain.
980128:  Applicant notified of intended recommendation for discharge with an uncharacterized service by reason of defective enlistment and induction due to erroneous enlistment as evidenced by a fracture of right ankle.
980128:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.
980129:  Commanding Officer, Recruit Training Command authorized applicant's discharge with an uncharacterized service by reason of defective enlistment and induction due to erroneous enlistment evidenced by a fracture of right ankle.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 980203 with an uncharacterized service for defective enlistment and induction due to erroneous enlistment (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).
In response to the applicant’s issue, the Board found that no other discharge characterization or reason for discharge is more fitting than the one received by the applicant. The applicant was only on active duty for twenty days and does not rate an honorable discharge. Even though the applicant may have received a waiver for his ankle, the fact remains that the applicant would not have been able to perform his duties at the time of his enlistment due to his injury which occurred prior to his enlistment. Therefore, an erroneous enlistment is warranted. The Board will not grant relief concerning this issue.
