Applicant’s Request

The application for discharge review, received 000613, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed VETERANS SERVICE OFFICE as her representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010111. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My name is M____ L P___ formerly M____ L P____. I was in the United States Navy from September 1987 through November 1998. I received an Other Than Honorable Discharge, which I respectfully request the discharge to be upgraded to Honorable. My reason are as follows: Events that only allow veterans to attend like fourth of July act, spiritual ceremonies that only veterans can attend, also have it legalized on paper that I am a United States veteran. I feel I was discharged under circumstances that I had no control and couldn't change anything at the time. In 1988, I was onboard the U.S.S. Acadia in July of that year I went on liberty with some friends, we all went down to Tijuana Mexico. While we were down in Tijuana my boyfriend at the time broke off our relationship. I was hurt and confused I started to drink more than usual. I met some people I never met before, I told P _____ (boyfriend's name) I knew the guy I was talking to and I said to go on without me. I told him it would be ok because these guys are from a brother company from boot camp, which the truth was I never knew them. Therefore, I told him to take off. I went back to their table and proceeded to get real drunk. The next thing I knew I was being hauled outside and put inside the back of a truck. This guy who was with them started to lace my lips with this drug I think was Crystal Meth. I blacked out after he crawled on top of me. I again woke up later at some room with three or four guys standing around who I guess were marines. I later found out it was a barrack at Camp Pendleton. I was so afraid for my life I felt I had to listen to whatever they said at the time. I was being passed around from one guy to the next. I didn't have sex with all of them only two of the four guys. So far the next day and a half I was sedated with Alcohol and Crystal Meth combined with the fear, shame, degradation of someone who supposed to be onboard with obligated duties. I was supposed to be on duty at the time I was gone so I was considered AWOL. Monday morning came, they didn't want to drive me back to the base I was just relieved to be let go I ran to the nearest phone. I tired calling the ship I was on but they didn't accept collect calls. I didn't call the police or any or my family members to let them know where I was because of the fear of being in trouble. I walked 180 miles that day from Camp Pendleton to San Diego, when I finally got back I was sent to Captain's Mast and put on restriction with extra duty. After this incident I didn't care anymore I got in trouble one more time which was not part of the incident at hand, I was 18 yrs old at the time which is pretty young to be being that it was my first time even being away from home, let alone living on a destroyer tender with over 2000 other people. I also waived all counsel when I departed from the service because I just wanted to go home a put this whole thing behind me. I am 30 yrs old and living a life way different than how "I grew up in the service". I greatly appreciate the time taken on my request and would be pleased to hear from you (s) any time in the near future.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 881117 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue ( a statement) provided no decisional issues for the Board’s consideration. Further, the applicant provided no post service documentation such as drug test reports, community involvement, educational pursuits, police records, and employment verification. The applicants Other Than Honorable discharge accurately characterizes her service. To change the discharge would be inappropriate. Relief is denied.

The applicant is reminded that she is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
