Applicant’s Request

The application for discharge review, received 000531, requested that the characterization of service on the discharge be changed to honorable or entry level separation or uncharacterized. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010104. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED (ENTRY LEVEL SEPARATION)/ERRONEOUS ENTRY (OTHER), authority: NAVMILPERSMAN, Article 3620280.

1. After I graduated Boot camp (succesfly) with high honors PSD called me to their office and instructed me to see a Doctor for a hearing problem. I did not pass my hearing test to a level acceptable for Aviation feild. I was offerd a possition of Perssonell man and Refused. I servied on my Boot camp honorably and wish to have my character of service changed to honorable Discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970919 with an entry level separation (uncharacterized) for defective enlistment and induction due to erroneous enlistment (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board found that the applicant was properly discharged with a discharge characterization as uncharacterized based on the fact that the applicant was in the service less than 180 days. Members in the service less than 180 days are normally separated with discharge characterizations as uncharacterized. No other discharge characterization would be appropriate in this case. No relief is granted based on this issue.
