Applicant’s Request
The application for discharge review, received 000508, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 001206. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

 1. I do hope to re-enlist in the military as a beginner of my goals and of retirement. An by re-enlisting I can prove to myself and to others that I am capable of doing the job with great obedience and corporation.

2. While restarting my military career, I would want to future educate family and myself by enrolling in college to study law. I feel that if I go to school and serve in the military at the same time it would help a whole lot with just doing one and not the other. In addition, like most people I would like to give my family a healthy life and a better start to by give them the chance to see new places and see the world.

3. In addition, the last but not the least is to honor and respectfully follow and obey my given duties in the military. As an apology to others and show them truthfully that I did not mean any harm toward my shipmates. I do know my conduct towards him was terribly wrong and that is why I would like to apologize to him and to my command ACB ONE for my behavior for my duties while at the command.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990408 under other than honorable conditions for misconduct due to commission of a serious offense (A and B) Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In the applicant’s issue 1, the Board has no authority to change re-enlistment codes or make recommendations to permit re-entry into the Naval Service or any other of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to re-enlistment. A request for waiver is normally done only during the processing of a formal application for enlistment.

 In the applicant’s issue 2, the Board has no obligation to change the applicant’s discharge in order to allow him to go back to school. No relief will be granted based on this issue.

The applicant’s issue 3 is a non-decisional issue for the Board.
