Applicant’s Request
The application for discharge review, received 000503, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 001102. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Pattern – frequent involvement of a discreditable nature with civil or military authorities, authority: NAVMILPERSMAN, Article 3630600.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My discharge on July 6, 1985 was at the time neither inequitable nor improper. I had been disobedient and failed to comply with the Navy's Code of Discipline on more than one occasion. However, since my discharge, I have proven myself to be an honorable and trustworthy citizen. Since my discharge, I have not only raised two daughters and maintained a stable home environment, I have also graduated from a two-year college and will in three semesters graduate from the University of Alabama with a degree in Elementary Education. While there remains no justification for my actions as an 18 year old delinquent child, I have now developed into a well-educated, trustworthy, dependable and hard-working mother & wife. I hope you will consider the changes in my behavior and my accomplishments in the years since my discharge in making your determination and will rule favorably on my request.

840614:  Retention Warning from Naval Submarine Support Facility New London, Groton, CT: Advised of deficiency (Alcohol abuse resulting in misconduct, patterns of misconduct.), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

840624:  NJP for violation of UCMJ, Article 128: Assault, violation of UCMJ Article 134: Drunk and disorderly.
         Award: Forfeiture of $200 per month for 2 months, extra duty for 30 days. No indication of appeal in the record.

850529:  Naval Submarine Support Facility New London notified applicant of intended recommendation for discharge under other than honorable conditions by reason of alcohol abuse rehabilitation failure, misconduct due to commission of a serious offense and misconduct due to misconduct- pattern – frequent involvement of a discreditable nature with civil or military authorities.
850529:  Applicant advised of her rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.
850612:  Commanding officer recommended discharge under other than honorable conditions by reason of alcohol abuse rehabilitation failure, misconduct due to commission of a serious offense and misconduct due to misconduct – pattern - frequent involvement of a discreditable nature with civil or military authorities.

850628:  CNMPC directed the applicant's discharge under other than honorable conditions by reason of misconduct - pattern – frequent involvement of a discreditable nature with civil or military authorities.
PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 850710 under other than honorable conditions for misconduct pattern frequent involvement of a discreditable nature with civil or military authorities (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

 The NDRB is authorized to consider post-service factors in the re characterization of a discharge. The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB.

The NDRB found that despite the applicant’s commendable accomplishments, her Other Than Honorable discharge most accurately characterized her service. Relief is not warranted.

The Board noted that a letter was sent to the applicant on 10 May 2000, advising her that she was very close to the 15 year limit and encouraged her to make a personal appearance. The applicant did not respond.
