Applicant’s Request
The application for discharge review, received 000229, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed the Disabled American Veterans as his representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000918. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

2. After a review of the Former Service Members (FSM) DD Form 293 Application for the Review of Discharge or Dismissal from the Armed Forces of the United States and all of the evidence assembled for review, it is found that (applicant's) requests a change of discharge from General/Under Honorable Conditions to Honorable.

890721:  Applicant briefed on Navy's policy on drug and alcohol abuse.

 891227:  NJP for violation of UCMJ, Article 92: Violation of a lawful general regulation by drinking alcohol under the age of 21 years on 24Nov89.
         Award: Forfeiture of $100 per month for 1 month. No indication of appeal in the record. [Extracted from CO's message dated 13Apr91.]
900907:  Civil Conviction: General District Court, Criminal Division, Hampton, VA for violation of breaking and entering.
 Sentence: Jail for 12 months plus court costs and barred from Kecoughton High School. Jail suspended for 3 years.

 901020:  Retention Warning: Advised of deficiency (Civil conviction on 7 September 1990 for unlawful entry.), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

910318:  NJP for violation of UCMJ, Article 112A: Wrongful use of LSD on 17Feb91.
         Award: Forfeiture of $376 per month for 2 months, restriction and extra duty for 45 days, reduction to FR. No indication of appeal in the record.
910318:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.
910318:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.
910330:  Medical evaluation for drug abuse found the applicant not to be drug dependent, but is psychologically dependent on alcohol. Recommend Level III treatment.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 910428 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In response to applicant’s issue 1, the Board found no reference to ‘lithium medication’ from Charleston Naval Hospital in the applicant’s medical record. The Board also sees no connection between the alleged lithium use and the applicant’s violation of UCMJ, Article 112A for wrongful use of LSD. Relief denied on the basis of this issue.

 In response to the applicant’s representative’s issue (issue 2), the NDRB determined that t o permit relief, an error or injustice must be found to have existed during the period of enlistment under review. There was nothing in the records, nor did the applicant provide any documentation, to indicate there existed an error of fact, law, procedure, or discretion at the time of discharge. There was no rights violation and no basis for relief.
