Applicant’s Request

The application for discharge review, received 000202, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000824. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Separation in lieu of trial by court martial, authority: NAVMILPERSMAN, Article 3630650.

The NDRB did note an administrative error on the original DD Form 214. Block 12a, Date Entered AD This Period should read: “1990 APR 10l” vice “1990 JUN 18”, Block 12c, Net Active Service This Period should read: “01 08 22l” vice “01 06 13”, Block 28, Narrative Reason for Separation should read: “Separation in lieu of trial by court martial” vice “DISCHARGED IN LIEU OF TRIAL BY COURT-MARTIAL”. The original DD Form 214 should be corrected or reissued as appropriate.

1. I have had this on my record for 8 years. There were no charges filled against me. I left it on my record and have not submitted this request before now due to the nature of discharge. I was told by councel when I agreed to my discharge that this could be done within 6 months of discharge. At this time I respectfully request that this discharge be updated to honorable. Thank you for any consideration you may give this matter.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 911231 under other than honorable conditions in lieu of a trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In the applicant’s issue 1, the Board found that the applicant went UA for 100 days and missed ship’s movement at least 3 times. The applicant was separated in lieu of trial by court martial with an other than honorable. The applicant therefore admitted guilt and signed a statement admitting this guilt with counsel’s advice. The Board found that the characterization of other than honorable was equitable based on the severity of the charges. There is no automatic upgrade to a discharge after 6 months. No relief will be granted based on this issue.

04 Mar 93, Article 3630650, PROCEDURES FOR PROCESSING ENLISTED PERSONNEL FOR SEPARATION IN LIEU OF TRIAL BY COURTMARTIAL.

B. A punitive bad conduct discharge may be adjudged for violation of the Uniform Code of Military Justice, Article [e.g., 86, unauthorized absence for a period more than 30 days] upon conviction by a Special or General Court-Martial, in accordance with the Manual for Courts-Martial.
