Applicant’s Request

The application for discharge review, received 991018, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000713. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. At the time of my service and discharge, I was young and very naive. My debt has been paid back to the Navy in full. I respectfully submit this application and request that the board review my records, and my discharge, and I respectfully request that my discharge be upgraded to honorable. Since being discharged from military service, I have learned valuable lessons about the importance of responsibility. I have a strong desire to have my discharge upgraded. I am now married, have children, and am currently a full-time student at Clovis Community College seeking an associate degree in computers.

During the time of my service there were no adverse actions in my career, my records were clean with the exception of this incident again I was young and very naive, my actions were not intentional, I had never had an account "checking" on my own before. I don't feel I was mature enough to handle this situation, and didn't show responsibility and good judgement.

910718:  Special Court-Martial.
         Charge I: violation of the UCMJ, Article 123A (45 specifications):
         Specification 1 - 45: Writing bad checks between 18 February 1991 and 6 May 1991
         Findings: to Charge I and specification 1 - 45 thereunder, guilty.
Sentence: Forfeiture of $75.00 pay per month for 2 months, restriction for 60 days, letter of reprimand.
         CA 910809: Sentence approved and ordered executed.

910919:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

910919:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

910924:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

911015:  CNP forwarded recommendation to Assistant Secretary of the Navy (Manpower and Reserve Affairs)

911031:  BUPERS directed the applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 920206 under other than honorable conditions for misconduct due to commission of a serious offense (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In the applicant’s issue 1, the Board
found that the applicant’s age, education level, and test scores qualified him for enlistment. While he may feel that his youth and immaturity were factors that contributed to his action, the record clearly reflects his willful disregard for the requirements of military discipline and demonstrated that he was unfit for further service. The record is devoid of evidence that the applicant was not responsible for his conduct or that he should not be held accountable for his actions.

A. Naval Military Personnel Manual, (NAVPERS 15560C), effective 15 Aug 91 until
04 Mar 93, Article 3630600, SEPARATION OF ENLISTED PERSONNEL BY REASON OF MISCONDUCT – COMMISSION OF A SERIOUS OFFENSE.

B. Under the Manual for Courts-Martial, a punitive discharge is authorized for violation of the Uniform Code of Military Justice, Article [e.g., 86, for unauthorized absence for a period in excess of 30 days] if adjudged at a Special or General Court-Martial.
