Applicant’s Request

The application for discharge review, received 000705, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020101. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Pattern of misconduct (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.3.

1. I have submitted the application to change my discharge from under other than honorable to general for the reason: My discharge was based on the fact that I could not be discharged "Hardship" and my family needed me. My unauthorized absence was the cause of this and I would have finished my remaining 8 months only, which I proudly served for 3yrs 8mos and received a certificate of commendation, along with others. It has been 7 years and would like to have the honor of having a general discharge thank you, semper fi I accepted an OTH to provide for my family.

         Finding: to Charge I and the specifications 1 and 2 thereunder, guilty; to Charge II and specifications 1 thereunder, guilty.
         Sentence: Confinement for 24 days, 3 days Bread & Water, forfeiture of $523.00, reduced to E-1.

921016:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. The factual basis for this recommendation was your nonjudicial punishments held on 900125 for violation of article 86 of the UCMJ and 920225 fro violation of article 86 of the UCMJ and in addition, your conviction by summary courts martial on 920603 for violation of article 86 of the UCMJ. 921106:  GCMCA [Commander, Marine Forces Pacific] directed the applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 930104 under other than honorable conditions for misconduct due to a pattern of misconduct (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

The applicant submitted no decisional issues. Further, the Board disagrees with the applicant’s statement, “My discharge was based on the fact that I could not be discharged “Hardship” and my family needed me.” The applicant’s discharge was based on his pattern of misconduct represented by two Non-judicial Punishments, a Summary Court-Martial, and three adverse counseling entries in his Service Record Book. Relief denied.

The Board found that the applicant’s age, education level, test scores, and family dependent status all qualified him for enlistment. While he may feel that his family was a factor that contributed to his actions, the record clearly reflects his willful disregard for responsibility and the requirements of military discipline and demonstrated that he was unfit for further service. The record is devoid of evidence that the applicant sought relief through his chain of command or that he was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The following is provided for the applicant’s edification. The NDRB is authorized to consider outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. However, there is no law or regulation that provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must be found to have existed during the period of enlistment in question. No such error or injustice is evident in the applicant’s service record. At this time the applicant has not provided sufficient documentation of good character and conduct. Therefore no relief will be granted. The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended
Pertinent Regulation/Law (at time of discharge)

A. Paragraph 6210, Misconduct , of the Marine Corps Separation and Retirement Manual, ( MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 86, unauthorized absence for more than 30 days.
