Applicant’s Request

The application for discharge review, received 000502, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed the Veterans of Foreign Wars as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 001116. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.

1. Current regulations state that processing for a discharge for Misconduct by reason of Minor Disciplinary Infractions or a Pattern of Misconduct,

"may not be initiated until the member has been counseled formally concerning deficiencies and has been afforded an opportunity to overcome those deficiencies as reflected in appropriate counseling or personnel records." 32 CFR Part 41, Appr. A Part 1 K, 2.

We refer this case to the Board for their careful and compassionate consideration and request the applicant's discharge be reviewed for an Honorable Discharge.

Poor work ethic and a near disrespectful attitude toward the chain of command and military courtesies. Since your arrival in the battery you have continually shown a total inability or unwillingness to conform to Marine Corps standards. You have lied, hidden from work details, always bordering on violations of the UCMJ. Continued efforts of your section head and his NCOS to help you have gone unheeded. 970806:          Applicant advised of his rights and having elected not to consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

970806:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. The factual basis for this recommendation was based upon his pattern of misconduct as evidenced by 2 Battalion NJPs.

970813:  Applicant waived administrative discharge board.

970910:  SJA review determined the case sufficient in law and fact.

970915:  GCMCA [Commanding General, 2d Marine Division, II Marine Expeditionary Force] directed the applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970916 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue, the Board found that he is in error. He was officially counseled on his deficiencies in performance and conduct on 970212 and 970213. Following these counseling’s, the applicant received 2 NJP’s within a 5 month period for violations of the UCMJ. Relief denied.

The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge (E). The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
