Applicant’s Request

The application for discharge review, received 000413, requested that the characterization of service on the discharge be changed to General/under Honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 001026. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ INVOL DIS (BOARD WAIVED) (PATTERN OF MISCONDUCT), authority: MARCORSEPMAN Par. 6210.3.

1. My behavior while serving in the Marine Corps was a reflection of personal problems at home. Since then I have worked hard to become a more responsible adult. My family and I are attempting to buy a home to make a better life for ourselves.

940323:  NJP for violation of UCMJ, Article 128: Did on or about 2200, 940319 wrongfully assault LCpl B____.
Awarded forfeiture of $217.00 per month for 1 month, restriction and

941031:  NJP imposed and suspended on 940912 for a period of 6 months is hereby vacated and the punishment is ordered executed.

941017:  Applicant notified of intended recommendation for discharge under Other Than Honorable conditions by reason of misconduct due to a Pattern of misconduct and Drug abuse.
941017:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ, Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

941017:  Commanding officer recommended discharge under Other Than Honorable conditions by reason of misconduct due to a Pattern of misconduct and Drug abuse. The factual basis for this recommendation was the respondent's derogatory counseling entries and three non-judicial punishments, one of which is for wrongful use of marijuana (THC).

941108:  GCMCA [Commanding General] directed the applicant's discharge under Other Than Honorable conditions by reason of misconduct due to a Pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 941123 under Other Than Honorable conditions for misconduct due to a Pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Board determined this issue is without merit. The applicant states his behavior was a reflection of personal problems at home, he is now a hard working responsible adult and attempting to buy a home. There was no documentation provided by the applicant or contained in his service record, to show he attempted to use his chain of command to resolve his personal problems. Additionally, there was no documentation provided by the applicant or contained in his service record to support his claim of being a responsible adult. Finally, the Board is under no obligation to upgrade an individual’s discharge for the purpose of purchasing a home. The applicant’s discharge accurately reflects his military service to his country. The Board determined this discharge was proper and equitable. Relief denied.
