Applicant’s Request

The application for discharge review, received 000412, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 001214. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety but found an inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall change and the reason shall remain the same. The discharge shall read: HONORABLE /PERSONALITY DISORDER, authority: MARCORSEPMAN Par. 6203.3


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My discharge was inequitable because it was based on an incident in which I was sexually assaulted by a group of Marines at a party. However, I wasn't supposed to be at the party, due to the fact that at the time I was only a junior Marine and they were seniors. I had too much to drink at this party, and as a result. I was sexually assaulted. I had also had other family problems prior to this incident in which all of these problems put together I became severely depressed. My self-respect and self-esteem just went downhill. I really at the time didn't feel I had an identity anymore. I began to think that everyone was against me at work. I began to feel as though I was just a dumb female and no one cares. My social life, especially with other Marines suffered. Other than these problems occurring, I feel that I wasn't a bad Marine, I just let my depression and low self esteem ruin my career, always wanting to be accepted. Finally, I feel that this discharge was inequitable because it was based solely on what happened to me and the embarrassment of other Marines, but not based on my mental status, or the fact that my depression was taking a toll on my life, and no one seemed to care. Ever since I got discharged in 19990604, have strived to make a positive impact on my life and my son's life. Sure, I look back and say to myself that there were things that I could have done differently but I can't turn back the hands of time I have to move forward, and I have. I was very proud to be a Marine. No, I'm not blaming anyone for me losing or destroying my career, because I did it myself. However, all I can do is pick myself up and keep going in life. Since July of 1999, I've learned a lot yes, its a whole new world from administration, in which I did in the Marine Corps. All I'm trying to say to you all is that I have made a positive life for myself and that I don't regret a day I became a United States Marine, despite all the problems I had. Thank you

990127:  Counseled for deficiencies in performance and conduct. [Lapse in judgment and use of alcohol in such a manner that your actions resulted in an alcohol related domestic dispute in military housing on 990111.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

990303:  Counseled for deficiencies in performance and conduct. [My failure to conform to prescribed weight standards as established by MCO 6100.10B.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

990518:  Medical evaluation by a military psychiatrist concluded that the applicant’s personality disorder was so severe that her ability to function effectively in the military environment was significantly impaired.

990525:          Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

990525:  GCMCA, Commander, Marine Forces Reserve, directed the applicant's discharge general (under honorable conditions) for convenience of the government due to a personality disorder.

990526:  Commanding officer recommended discharge under honorable conditions (general) for the convenience of the government due to a personality disorder, based upon a diagnosed personality disorder as evidenced by psychological evaluation. The factual basis for this recommendation was diagnosed with adjustment disorder with depressed mood and personality disorder.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990604 general (under honorable conditions) for convenience of the government due to a personality disorder (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but inequitable (D and E).

The NDRB found the applicant’s issue non decisional. The applicant presented issues relating to the circumstances surrounding her discharge as matters of extenuation and mitigation. Relief based on this issue is not warranted.

The Board, however, reviewed the applicant’s service record and found, based on her proficiency and conduct marks that her overall service warranted an Honorable discharge. Relief is granted.
