Applicant’s Request

The application for discharge review, received 991228, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000831. After a thorough review of the records, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Physical disability, existing prior to entry (determined by a medical board), authority: MARCORSEPMAN Par. 8404.

911108:  NJP for violation of UCMJ, Article 86: unauthorized absence from 0200, 911106, to wit: applicant did absent himself from appointed place of duty, firewatch. Unauthorized absence from 1800, 911006, to 1500 911025 (19 days).
Awarded forfeiture of $300.00 per month for 1 month, restriction for 30 days, reduction to E-1. Appeal submitted 911108. Appeal findings acknowledged 911122. Restriction for 30 days, stayed.

911121:  Convening Authority of Medical Board (NAVHOSP Camp Pendleton, CA) found that applicant was not physically qualified due to Pes Cavus, Bilateral, Symptomatic with Military Training, that the condition existed prior to entry and recommended that the applicant be discharge in accordance with MARCORSEPMAN Article 8404 and MCO P1900.16D.

911204:  GCMCA [CG, MCB, Camp Pendleton] advised CMC that applicant's discharge was approved and his discharge was directed by reason of a physical disability which existed prior to entry into the service, without severance pay and the characterization of service is general (under honorable conditions).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 911219 Under Honorable Conditions (General) due to physical disability, existing prior to entry (determined by a medical board) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant introduced no decisional issues for consideration by the Board.

The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge (D). The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant
is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
