Applicant’s Request

The application for discharge review, received 991112, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant designated the Veterans of Foreign Wars as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000817. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Fulfillment of Service Obligation service, authority: MARCORSEPMAN Par. 1005.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I wish to have discharge upgrade to Honorable. I am attempting to form my own company to peddle material in the State and have been advised my discharge must be Honorable.

2. IAW SECNAV Instruction 5420.174C of 22 August 1984 (MDR 1984), enclosure (1), chapter 9, paragraph 9.3, Equity of discharge, we ask the Board to consider the following factors:
•        
Clemency is warranted because the applicant is suffering adverse consequences of his bad discharge. Reference his attempt to form his own company. His discharge is preventing him form expanding his business to government contracting.

3. We ask the Board to consider the applicant's case IAW SECNAV Instruction 5420.174C of 22 August 1984 (MDR 1984), enclosure (1), chapter 9, paragraph 9.2, Propriety of Discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 870305 with a General (Under Honorable Conditions) due to Fulfillment of Service Obligation (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue, and that of his representative, is that he warrants clemency because he is suffering the adverse affects of his bad discharge. The discharge the applicant was issued was a general discharge, not a bad discharge, as stated. The applicant’s discharge was based on the type warranted by service record. The applicant’s average proficiency and conduct marks were 4.1/3.8 respectively. To warrant an honorable discharge the average conduct mark must be no lower that 4.0. The discharge clearly characterizes his service in the Marine Corps. Relief denied.

The applicant should consider himself lucky that he did not receive an under other than honorable (OTH) discharge. His NJP for use of marijuana normally warrants such a discharge.
