Applicant’s Request

The application for discharge review, received 991104, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000727. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.

1. My discharch was undesirable because I have (6) six acounts (UA) unauthorized absence because I went to the hospital to be with my wife who was very sick at the time and pregnant with my daughter. Attach doctors notes.

Violation of UCMJ, Article 121:
Specification: Defraud Home Depot of $168.88 after being given the cash to purchase a BOM for MWSG-37, applicant returned with 12 sheets of plywood with no proof of purchase on 13May97
Awarded forfeiture of $450.00 per month for 2 months, restriction for 45 days, reduction to Pvt. Forfeiture and restriction suspended for 6 months. Not appealed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970818 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board found that the documentation he provided does not verify his allegations. The letters from the doctors were for events that did not occur on the days he was charged with UA. The applicant was UA for 7 days, failed to report at the times indicated 3 times, and defrauded Home Depot of $168.88. Clearly the applicant had a problem that was not related to the illness of his spouse. Relief denied.
