Applicant’s Request

The application for discharge review, received 990329, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000104. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues (verbatim)

1. I believe my discharge was improper because of a prior incident in which UCMJ article 86 was brought against me (04 Oct 83) under false pretense by DTCH M.A.H_____, I have the statement he sent to LCDR M_____ which was concocked in my presence in his office. I at least got a copy of which he was not going to let me have, see the attached statement its his finale version, however there is only one thing true on it, which is I don't want you here if you don't feel good. Everything else is a crock. I called in a 7:45am 04 Oct 83 I said I was sick he said he didn't want me there, I told him I could get a ride into sick call he said just stay home, so I did the next day I came in & was wrote up for being AWOL for 24 hours. I requested a meeting with Master Chief H_____ he put me off for days when he did finally see me he kept me in his office for hours writing & rewriting this statement I did what I was told. I went to mast with someone who had a positive for marijuana test. We ultimately got the same punishment. So I was ferious with the Master Chief & the C.O he did not see I just received meritorious mast received a strip. So I told the CO if the only punishment was $600 & a strip I wide as while go smoke a joint. I did, they pulled command sweep. Ultimatley discharged other than honorable, I believe I would be retiring from the Navy about now if this injustice never occurred. And as far as charter it has grown in bundles since this time in my life.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 840330 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board found no merit in the applicant’s claim that the discharge was improper due to a charge “under false pretense.” The applicant was discharged with an other than honorable for misconduct due to drug abuse. She could have been dual processed for misconduct due to commission of a serious offense based on her assault charges and her drug related incidents. Additionally, she could have been processed for misconduct-pattern of misconduct for having 3 NJPs. One drug incident is enough to warrant an other than honorable discharge. The applicant was positive for marijuana, cocaine and morphine in addition to her 3 non-judicial punishments. Relief is denied.
