Applicant’s Request
The application for discharge review, received 990412, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000121. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/IN LIEU OF TRIAL BY COURT MARTIAL, authority: NAVMILPERSMAN, Article 3630650.

The NDRB did note an administrative error on the original DD Form 214. Block 18, Remarks, should include the following statement: “Continuous honorable active service from 880629 until 930107”. The original DD Form 214 should be corrected or reissued as appropriate.

1.To whom it may concern I E---- P. D----- Jr. have or was in the U.S. Navy 7 years 1988-95. I have given the Navy 6 great years. My 7 th year the trouble began and I went UA. I was told while I was in the Brig my discharge would be upgraded but it is still is Other Than Honorable (OTH). If you could please help me I would appreciate if you could upgrade my discharge because one mistake after 6 years should not determine if I’m a US veteran or not so please review my file and make the right decision because I think I deserve it, Thank you. .

941212:  Applicant arrested by civil authorities for possession of stolen property and obstructing a public servant. Returned to military authorities and placed on restriction. Applicant then broke restriction. Applicant to unauthorized absence. Intentions unknown.

950113:  Applicant declared a deserter.

950227:  Applicant apprehended.

950316:  Applicant requests a trial in lieu of court martial.

950320:  Discharge with an OTH in lieu of court martial approved.
         (Note: No other aspects of discharge package in service record).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 950328 under other than honorable conditions in lieu of a trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

The Board found nothing in the records, nor did the applicant provide anything to indicate or to show that there exists an error of fact, law, procedure, or discretion, associated with his discharge at the time of issuance, and that his rights were prejudiced thereby. Furthermore, there has been no change in policy by the Navy, or higher authority, made expressly retroactive to the type of discharge received by the applicant. Relief is therefore denied.

22 Jul 94 until 2 Oct 96, Article 3630650, PROCEDURES FOR PROCESSING ENLISTED PERSONNEL FOR SEPARATION IN LIEU OF TRIAL BY COURTMARTIAL.

B. A punitive bad conduct discharge may be adjudged for violation of the Uniform Code of Military Justice, Article 86, unauthorized absence for a period more than 30 days, upon conviction by a Special or General Court-Martial, in accordance with the Manual for Courts-Martial.
