Applicant’s Request

The application for discharge review, received 990308, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000121. After a thorough review of the records, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct - Pattern of Misconduct, authority: NAVMILPERSMAN, Article 3630600.


The NDRB noted that the service record did not contain the DD Form 214. Member states that his DD Form 214 was lost and he has been unable to obtain a copy of it, accordingly, the NDRB reviewed this case without the DD Form 214, using a discharge date of 12APR92 .

Commanding officer’s comments (verbatim): "SA (Applicant) has had the full benefit of counseling given by his entire chain of command since the first day he reported on board. He has shown a consistent lack of regard for his responsibilities and a lack of potential for improvement or naval service. A review of his service record demonstrates a pattern of misconduct. It is recommended that SA (Applicant) be separated due to misconduct as evidenced by a pattern of misconduct, and that a service characterization of General be assigned due to the less serious nature of his disciplinary infractions.

920330:  BUPERS directed the applicant's discharge under honorable conditions (general) by reason of misconduct due to a pattern of misconduct.

Discussion

The applicant was discharged on 920412 under honorable conditions (general)for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant introduced no decisional issues for consideration by the Board.
