Applicant’s Request

The application for discharge review, received 990129, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant listed D___ G____ of the Georgia Dept. of Veterans Service as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000121. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 3630600.





PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1.      
Trouble resulted from financial problems not of my own making. The problems developed due to an overpayment. My efforts to resolve the problem went to no avail.

2.      
Failure of my chain of command to respond appropriately. I presented a check for payment which was not forwarded.

3.      
I was unable to report for court appearances due to overseas assignments. This created additional financial and legal problems for me.

4.      
I was told that I would be given an administrative discharge – general under honorable conditions. This did not happen.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 960910 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Regarding the applicant’s first three issues, the Board found nothing in the records nor did the applicant submit any supporting documentation that showed that his personal and financial problems were of sufficient magnitude that they could not be resolved through standard military channels or by the applicant’s chain of command. Relief denied.

After reviewing the applicant’s entire service record, the Board determined that the characterization of the discharge as Other Than Honorable was proper and equitable. The applicant was provided with all appropriate due process in the separation process, including the notification that his discharge would be characterized as Other Than Honorable.

The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge (E). The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
