Applicant’s Request

The application for discharge review, received 981218, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000110. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. 1. I am requesting an upgrade in my discharge from General under honorable conditions to an Honorable discharge. In the past couple of years I have made a strong effort to better my life and will definitely continue do so. I realize that an upgrade in my discharge can make a significant difference in both my upcoming education and most of all my career opportunities. I am a very changed man with many ambitions and goals which I have set for my self with every intention of success. I have grown up and matured a tremendous amount and would very much like to leave my childhood mistakes in my past, allowing me to establish a strong foundation on which to build my future. I plan to attend college of arts in the beginning of the year and to continue being the best person that I know how to be

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970912 general under honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue, the Board found the applicant’s youth and immaturity are not sufficient factors to exculpate him from the consequences of his misconduct.

Further, there is no law or regulation that provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life subsequent to leaving the service.

The Board found nothing in the records, nor did the applicant provide anything to indicate or to show what there were errors of fact or law associated with his discharge at the time of its issuance.

Accordingly, relief is denied.
