Applicant’s Request

The application for discharge review, received 990920, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000720. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned an inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall change. The discharge shall change to: HONORABLE/WEIGHT CONTROL FAILURE, authority: MARCORSEPMAN 6215.






PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My wife and I were very upset and depressed. I knew that I wasn't going to see my family for an entire year. The first few months were the most difficult. I had difficulty adjusting. I started to gain a few pounds. I left Okinawa weighing 182. My next and final duty station was Camp Pendleton, Ca. That is where things got worse. My wife and I were not getting along very well. I was also gaining more weight. About the last year of my tour my wife left me. I was a total mess. I was weighing in about 192 and my life was a total mess. I tried several diets to lose the weight, but nothing would work. I was told by my drill instructor in boot camp that it's great I lost all that weight, but unfortunately most marines gain it all back. That I did. I had trouble keeping up with the company pt sessions. Approximately 04/98 1 receive notification that I was being discharged from the Marine Corps. To tell the truth, at that point I was so depressed I didn't care anymore. Finally on 05/15/98 1 was discharged from the Marine Corps.

I believe that my discharge was unfair because I didn't commit a crime. I have never had an njp. Or office hours. The only Page eleven entries were because of my weight. I was the best marine I could be. I am now working for a sign supply company. I am doing fairly well in it. I am also going to the Community College of Southern Nevada. I wish to continue my education and receive my degree in criminal justice. My main reason for this request of an upgrade is for educational benefits. My GI bill. PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980515 general under honorable conditions due to weight control failure (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (C and D).

The Board determined that the discharge was not based on the type warranted by service record. The applicant had no NJP’s and his average proficiency and conduct marks were 4.3/4.2 respectively, thus warranting an honorable discharge. Relief granted.
