1. Pursuant to the provisions of reference (a), Petitioner
applied to this Board requesting his naval record be corrected to
show that he was not discharged from the Navy Reserve on 15 June
2009.

2. The Board, consisting of Ms. eugeie. ue allie and Mr.
ME. ceviewed Petitioner's allegations o rror and

injustice on 18 March 2010 and, pursuant to its regulations, |
determined that the corrective action indicated below should be
taken on the available evidence of record. Documentary material
considered by the Board consisted of the enclosures, naval
records, and applicable statutes, regulations and policies.

   

3. The Board, having reviewed all the facts of record pertaining
to Petitioner's ailegations of error and injustice, finds as
follows:

a. Before applying to this Board, Petitioner exhausted all
administrative remedies available under existing law and
regulations within the Department of the Navy.

b. In correspondence attached as enclosure (2) the
Commander Navy Personnel Command {NPC) advised the Board, in
effect, that Petitioner was discharged in error. He recommends
that Petitioner’s request be granted.

CONCLUSION :
Upon review and consideration of all the evidence of record, and
in view of the contents of enclosure (2) the Board finds the

existence of an injustice warranting the following action.

RECOMMENDATION :

 

a. That Petitioner's naval record be corrected to show that he
was not discharged on 15 June 2009, and that all information
pertaining to the discharge be removed from his record.
b. That Petitioner be given authorized absences for the drills
he missed during the period 15 June 2009 to the date of
implementation of this action.

4. It is certified that a quorum was present at the Board's
review and deliberations, and that the foregoing is a true and
complete record of the Board's proceedings in the above entitled

matter.

5. Pursuant to the delegation of authority set out in Section
6(e) of the revised Procedures of the Board for Correction of
Naval Records (32 Code of Federal Regulations, Section 723.6(¢))
and having assured compliance with its provisions, it is hereby
announced that the foregoing corrective action, taken under the
authority of reference (a), has been approved by the Board on
behalf of the Secretary of the Navy.

    Pursuant to the provisions of reference (a), Petitioner applied to this Board requesting her naval record be corrected by changing the reentry code she was assigned on 1 September 2009. A Sailor who is found to pe not physically qualified for enlistment may, in the alternative, pe separated by reason of erroneous entry and assigned a reentry code of RE-3E or RE-4.
