L. Pursuant to the provisions of reference {a), Petitioner, a
former enlisted member of the Marine Corps, filed enclosure (1)
with this Board requesting that his reenlistment code (RE-4) be
changed.

 

2. The Board, consisting of Messrs Leeman, Neuschafer and Ms.
McCormick, reviewed Petitioner's allegations of error and
injustice on 19 May 2009. Pursuant to its regulations, the
Board determined that the corrective action indicated below
should be taken on the available evidence of record.
Documentary material considered by the Board consisted of the
enclosures, naval records, and applicable statutes, regulations
and policies.

3. The Board, having reviewed all the facts of record pertaining
to Petitioner's allegations of error and injustice finds as
follows:

a. Before applying to this Board, Petitioner exhausted all
administrative remedies available under existing law and
regulations within the Department of the Navy.

b. Although it appears that Petitioner's application to the
Board was not filed in timely manner, it is in the interest of
justice to waive the statute of limitations and review the
application on its merits.
performance was exemplary which attested to by his promotion to
corporal and by the extremely laudatory letters from key members
in his chain of command regarding his attitude and performance.
And finally the Board recognized Petitioner’s post-service
achievements and his desire to resume military service. The
cumulative effect of these factors leads the Board to believe
that the interests of justice would better served if
Petitioner's RE-4 reenlistment code were to be changed to RE-1.

RECOMMENDATION:

a. That Petitioner's naval record be corrected to show that
he was issued an RE-1 reenlistment code on 26 June 2001 vice the
RE-4 reenlistment code that was issued on the same day.

4, It is certified that a quorum was present at the Board's
review and deliberations, and that the foregoing is a true and
complete record of the Board's proceedings in the above entitled

matter.
