This is in reference to your application for correction of your
naval record pursuant |to the provisions of title 10 of the
United States Code, section 1552.

A three-member panel olf the Board for Correction of Naval
Records, sitting in executive session, considered your
application on 14 the Bo 2008. After careful consideration of

 

your application, the Board concluded that your application was
not timely filed, and that it would not be in the interest of
justice to excuse your |failure to submit your application ina

timely manner.

The Board did not acceyt your contention to the effect that you
discovered the alleged jerror or injustice in your record in
2008, when you obtained a copy of your Navy health record. The
Board found that on 24 september 1968, you attached a copy of a
report of psychiatric evaluation to your request for
conscientious objector btatus. That report clearly states that
you had been diagnosed with a schizoid personality disorder.
Your service record alsb contains a copy of a letter dated

lL April 1970, in which you advised Senator Alan Cranston, in
part, that you had been| “recommended by Dr. Mc Dermott for
immediate discharge for psychiatric reasons as being completely
unsuitable for the Marine Corps”, and that Dr. McDermott felt
that you should have bedn discharged for psychiatric reasons in
1967. In addition, the decision of the Naval Discharge Review
Board, which was sent td you on 12 June 1978, contains entries
concerning the diagnosis| of schizoid personality, and the
recommendation of a psychiatrist, dated 25 July 1969, that you

be discharged by reason bf unsuitability.
You may request reconsideration of this decision. Your request
must include newly dilscovered relevant evidence which was not
reasonably available |to you when you submitted your application.
The evidence may pertlain to the timeliness of your application
or to its merits. Absent such additional evidence, further
review of your applicktion is not possible.

It is regretted that bh more favorable reply cannot be made.
