1. Pursuant to the provisions of reference (a), Subject hereinafter referred to as Petitioner,
filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be
corrected to show that his Pay Entry Base Date is 25 March 1980 and he did not have a break
in service when he entered active duty 6 January 1986.

2. The Board, consisting of Messrs.
Petitioner’s allegations of error and injustice on 10 June 2003 and, pursuant to its regulations,
determined that the corrective action indicated below should be taken on the available
evidence of record. Documentary material considered by the Board consisted of the
enclosures, naval records, and applicable statutes, regulations and policies.

3. The Board, having reviewed all the facts of record pertaining to Petitioner
of error and injustice, finds as follows:

a. Before applying to this Board, Petitioner exhausted all administrative remedies

available under existing law and regulations within the Department of the Navy.

CONCLUSION

Upon review and consideration of all the evidence of record, and especially in light of
contents of enclosure  
(2), the Board finds the existence of an injustice warranting the
following corrective action.

RECOMMENDATION:

That Petitioner’s naval record be corrected, where appropriate, to show that:

a.

Petitioner’s delayed enlistment of 25 October 1985 is null and void.

b. When Petitioner enlisted on 25 March 1980 he incurred a reserve service obligation

of six (6) years. He enlisted USN for active duty on 1 October 1980 and was released from
active duty on 1 October 1980 and assigned to the USNR for the remainder of his reserve
obligation.

C. On 5 January 1986 Petitioner was discharged from his reserve contract of

25 March 1980 on the condition that he immediately enlist USN for active duty. Petitioner
enlisted USN on 6 January 1986 for 6 years,
paygrade E-5. Petitioner ’s PEBD will be
25 March 1980.

 

d. That a copy of this Report of Proceedings be filed in Petitioner
