This is in reference to your application for correction of your naval
record pursuant to the provisions of Title 10 of the United States Code
section 1552.
A three-member panel of the Board for Correction of Naval Records,
sitting in executive session, considered your application on 24 February
2003. Your allegations of error and injustice were reviewed in accordance
with administrative regulations and procedures applicable to the
proceedings of this Board. Documentary material considered by the Board
consisted of your application, together with all material submitted in
support thereof, your naval record and applicable statutes, regulations
and policies.
After careful and conscientious consideration of the entire record, the
Board found that the evidence submitted was insufficient to establish the
existence of probable material error or injustice.
The Board found that you enlisted in the Navy on 3 August 1992 for four
years at age 18. On 12 April 1993 you received a psychological evaluation
due to claustrophobia and were diagnosed as having a dependent and anti-
social personality disorder. It was recommended that you be expeditiously
processed for administrative separation due to the risk of harm to
yourself and others.
On 16 April 1993 you were counseled concerning your performance and
conduct and warned that further deficiencies could result in disciplinary
action or administrative separation.
On 8 May 1993 you were involved in an on-base alcohol related incident,
which resulted in your apprehension by base security
personnel. You made claims that you had been assaulted, however, a thorough
investigation found that the injuries you sustained were the result of your
own misconduct.
On 10 June 1993 your division officer recommended that you be processed for
administrative separation due to your lack of improvement and your alcohol
related incident since the 16 April 1993 counseling. It was further
indicated that you had requested separation.
On 27 June 1993 you were notified that separation action was being
initiated for the convenience of the government due to the diagnosed
personality disorder. You were advised of and waived all of your procedural
rights. On 2 July 1993 you were honorably discharged and assigned an RE-4
reenlistment code.
Regulations authorize the assignment of an RE-4 or RE-3G reenlistment code
to an individual separated by reason of personality disorder. An RE-4
reenlistment code is often assigned if an individual is thought to
constitute a threat to himself or others. Therefore, due to the severity of
your personality disorder, the Board concluded that the RE-4 reenlistment
code was properly assigned and no change is warranted. Accordingly, your
application has been denied. The names and votes of the members of the
panel will be furnished upon request.
It is regretted that the circumstances of your case are such that favorable
action cannot be taken. You are entitled to have the Board reconsider its
decision upon submission of new and material evidence or other matter not
previously considered by the Board. In this regard, it is important to keep
in mind that a presumption of regularity attaches to all official records.
Consequently, when applying for a correction of an official naval record,
the burden is on the applicant to demonstrate the existence of probable
material error or injustice.
