Pursuant to the provisions of reference (a), Subject hereinafter referred to as Petitioner,
filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be
corrected to show that Petitioner ’s time in rate (TIR) date for
as of the date he entered active duty.

2. The Board, consisting of Messrs Dunn, Neuschafer, and M S 
Petitioner’s allegations of error and injustice on 14 November 2001 and, pursuant to its
regulations, determined that the corrective action indicated below should be taken on the
available evidence of record. Documentary material considered by the Board consisted of the
enclosures, naval records, and applicable statutes, regulations and policies.

3. The Board, having reviewed all the facts of record pertaining to Petitioner
of error and

a. Before applying to this Board, Petitioner exhausted all administrative remedies

available under existing law and regulations within the Department of the Navy.

b. After reviewing the correspondence attached as enclosure  

that the request has merit and warrants favorable action.

Upon review and consideration of all the evidence of record, and especially in light of the
contents of enclosure

That Petitioner’s naval record be corrected, where appropriate, to show that:

Petitioner was dropped from Nuclear School due to medical reasons effective

paygrade E-l effective
15 February 2001 and administratively reduced in rate to
15 February 200 1. His TIR was established as 19 June 2000 which was the date
he entered active duty.

 

Petitioner was advanced to  

paygrade E-2 effective 16 April 2001.

b.
BuPers Instruction Manual  
with 
E-2 and E-3 on the 16th of the month. If the TIR for advancement to E-2 or E-3 is
completed after the 16th of the month they will be advanced  
month. Petitioner completed TIR requirements for E-2 on the 19 March 2001 so he is
eligible to be advanced   on 16 April 200 1)

1439.16D servicemembers will be advanced to paygrades
