Issues: The applicant states, in effect, that she wants to use her DD Form 214 for the purpose of obtaining her Post 911 GI Bill and to increase her percentage for her benefits.  She disagrees with the uncharacterized discharge she received.   She graduated from basic training and advance individual training at the top of her class.  Out of all her fellow Soldiers, she graduated physical training of the cycle for basic and advance individual training.  She was the only female out of her whole class to receive an award and feels that her discharge may have been blanketed to her entire requesting that hers be reevaluated.  She was unaware at the time that her discharge would affect her benefits.  She is only now wanting her DD Form 214 reevaluated due to the VA bringing light to it.

VI.  Facts, Circumstances, and Legal Basis for Separation

       a.  Facts and Circumstances:
       The evidence of record shows that on 30 July 2004, Department of Defense, Chicago Military Entrance Processing Station, Des Planes, IL issued Orders 4212022, to the applicant for the purpose of MOS training (31B10) for approximately 17 weeks or until completion of basic and MOS training.  
       
       Further, the record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature.  Her DD Form 214 indicates she was released from active duty training under the provisions of Chapter 4, AR 635-200 by reason of completion of required active service, with service uncharacterized.  
       
       Furthermore, the DD Form 214 shows a Separation Code of MBK (i.e., completion of required active service).  Following completion of MOS training course, the applicant was released from active duty training, with an effective date of 17 November 2005, and transferred to the Army National Guard of Illinois.

       b.  Legal Basis for Separation:  
       Army Regulation 635-200 sets forth the basic authority for separation of enlisted personnel.  Chapter 4 of that regulation provides, in pertinent part, for the separation of individuals at completion of required service (i.e., expiration term of service).  The characterization of service for Soldiers separated under the provisions of Chapter 4, AR 635-200, will be honorable unless the Soldier is in an entry-level status.  The service of Soldiers in an entry-level status will be uncharacterized.  A Soldier is in an entry-level status if the Soldier has not completed more than 180 days of creditable continuous active duty at the time of the discharge or relief from active duty.  

       c.  Response to Issues, Recommendation and Rationale:  
       After a careful review of all the applicant's available military records during the period of enlistment under review, the issue and document she submitted, the analyst recommends that relief be denied in this case.  
       
       The evidence of record shows that the applicant, while in entry-level status, was released from active duty for training under the provisions of Chapter 4, AR 635-200, by reason of completion of required active service, with service uncharacterized.  The characterization of service for Soldiers separated under this provision of the regulation will normally be honorable, unless the Soldier is in entry-level status.  A Soldier is in entry-level status for the first 180 days of continuous active duty.  Army Regulation 635-200 also provides, except in cases of serious misconduct, that a Soldier’s service will be uncharacterized when separated in entry-level status.  For ARNG and USAR Soldiers ordered to IADT/ADT, entry-level status terminates 180 days after the beginning of training.  
       
       Furthermore, for Soldiers in entry-level status, a fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty.  The analyst determined no such unusual circumstances were present in the applicant’s record and the former Soldier’s service did not warrant an honorable discharge.  
       
       The analyst noted the applicant's issue that she wants to use her DD Form 214 for the purpose of obtaining her Post 911 GI Bill and to increase her percentage for her benefits.  Eligibility for veteran's benefits to include educational benefits under the Post-9/11 or Montgomery GI Bill does not fall within the purview of the Army Discharge Review Board.  Accordingly, the applicant should continue to contact a local office of the Department of Veterans Affairs for further assistance.
       
       In view of the aforementioned, the analyst determined that the reason for discharge and characterization of service were both proper and equitable.
