Issues: The applicant states, in effect, that he would like his reentry eligibility (RE) code changed to 1, so that he can reenlist and return to the Army. His discharge from the service occurred because he needed to help his mother who was ill at the time and to take care of his younger brother. It was suggested that he provide financial support, but felt it was not a workable solution and he needed to be there physically with his family. His brother had no place to live and he was 17 at the time. There is no reason that he can not serve his country now and he desires to do so.

VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
The specific facts and circumstances leading to the applicants discharge from the Army are not contained in the available records. The regulation requires an uncharacterized discharge for separation under this Chapter.
c. Response to Issues, Recommendation and Rationale:
After a careful review of all the applicants available records for the period of enlistment under review, and the issue submitted with the application, the analyst found no mitigating factors which would merit an upgrade of the applicant's discharge.
The applicants record is void of the specific facts and circumstances concerning the events which led to the discharge from the Army. However, the applicants record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). Therefore, based on the available evidence, the analyst presumes government regularity in the discharge process and determined that the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief.
