Issues: The applicant states, "In december of 2008 I was discharged, as it stated, unsatisfactory performance.  In February-March of 2007 I began to have black outs that were unexplained.  In May of 2007 I was givin the opportunity to deploy or get discharged and I chose to deploy.  Knowing that I was ill, the doctors could not pin point what was wrong.  I was sent back and from June 2007-November 2008 there were multiple test ran upon me.  As the time went by doctors were finding things but could not actually be accurate where or how these things were happening.  Two of my doctors requested that I be med board, but my unit felt I did not deserve that because I could not deploy.  I was still undergoing treatment but was not able to finish because my unit felt I should be discharged immediately.  Til this day I am still having medical issues and I have went to VA.  I was appointed a doctor and they are trying to help me the best way possible.  I feel I should have been med boarded or sent somewhere where I could have had a better chance of getting better medical assistant.  My doctor told me because he could not pin point where everything was coming from it did not rule out that I was ill.  I really would appreciate it if my discharge was changed to honorable or for medical reasons."

VI.  Facts, Circumstances, and Legal Basis for Separation

       a.  Facts and Circumstances:
       The evidence of record shows that on 27 October 2008, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance for  being unable to perform her military duties because of feigning illness and injury on diverse occasions and being late for duty on two occassions with a general, under honorable conditions discharge.  She was advised of her rights.  
       On 30 October 2008, the applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in her own behalf.  The unit commander subsequently recommended separation from the Army and waiver of further rehabilitative efforts.  The intermediate commander reviewed the proposed discharge action and recommended approval with a general, under honorable discharge.  
       On 21 November 2008, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge. 

       b.  Legal Basis for Separation:  
       Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this Chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory Soldier.  Army policy states that a general, under honorable conditions discharge is normally considered appropriate, however, a fully honorable discharge may be granted in meritorious cases.

       c.  Response to Issues, Recommendation and Rationale:  
       After a careful review of all the applicant’s military records and the issue submitted with the application, the analyst found no mitigating factors that would merit an upgrade of the applicant's discharge.  There was a full consideration of all faithful and honorable service as well as the incidents of unsatisfactory performance.  
       The analyst determined that the applicant’s discharge was appropriate because the quality of the service was not consistent with the Army’s standards for acceptable personal conduct and performance of duty by military personnel.  By the unsatisfactory performance, the applicant diminished the quality of service below that meriting a fully honorable characterization of service.  
       The analyst noted the applicant's issue and the record does not support the applicant’s contention concerning a medical board, and no evidence to support it has been submitted by the applicant, that the discharge was the result of any medical condition.
       Therefore, the analyst determined the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief.
