      The Army Discharge Review Board reviewed your case and determined

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 11 January 2002, the
applicant was charged with AWOL (001116-001119; disrespect to a LTC;
disrespect to a CPT; wrongfully using cocaine; and assaulting a SGT who was
in the execution of his law enforcement duties.  On 28 January 2002, the
applicant consulted with legal counsel and voluntarily requested, in
writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu
of trial by court-martial.  In this request, the applicant admitted guilt
to the offense, or a lesser included offense.  Further, the applicant
indicated that she understood that she could receive an under other than
honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits.  The applicant
did not submit a statement in her own behalf.  The unit commander
recommended approval of an under other than honorable conditions discharge.
 On 5 February 2002, the separation authority approved the discharge with
an under other than honorable conditions discharge.  The applicant was to
be reduced to the lowest enlisted rank.

      b.  On 11 February 2002, the applicant was discharged.  At the time
of discharge, the applicant had completed 2 years 15 days of active
military service and accrued 4 days of lost time due to AWOL in the period
under review and had a total of 8 years, 2 months and 3 days of military
service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board found that the length and quality
of the applicant’s service, and the circumstances surrounding the
applicant’s discharge, mitigated her misconduct.  Based on the above, the
Board determined that the discharge granted is now inequitable.
Accordingly, the Board voted to grant relief in the form of an upgrade of
characterization of service to fully honorable and to change the narrative
reason for discharge to Secretarial Authority.  This action does not
include a change in RE code.

    Inasmuch as the Board voted to grant the full relief requested,
